The Ministry of economic development criticized the bill of the Ministry of Finance “On the labeling of goods with control (identification) signs”. The document provides for the creation of a national “system of traceability” of the goods in the country, and also prohibits the storage, transportation and sale of unmarked products. The experts of the Ministry of economy noted, the opacity of the criteria for the definition of products for mandatory labeling and voluntary involvement of the organization.
The Ministry of Finance has prepared a draft law “On the labeling of goods with control (identification) signs in the Russian Federation”, fulfilling the instructions of Deputy Prime Minister Igor Shuvalov. At the end of November 2016 has started a public discussion document. Now he is in the process of interagency coordination.

The document establishes the legal framework for marking of goods with control (identification) signs (KIZ) in Russia and functioning national system of traceability of goods turnover. It also explains how regulated the legal relations connected with creation and use of KEYS for marking goods, the turnover of products in the country and the implementation of supervision of observance of the established norms.
The Ministry of economic development amounted to comments on the draft of the Ministry of Finance with remarks, concluding that “the draft Federal law needs work” (a copy of the document is at the disposal of “Izvestia”). The Finance Ministry got acquainted with him on 3 February, said the Ministry. In opinion the Ministry of economy did not agree with the norms of the draft on the compulsory and voluntary labelling systems. The Finance Ministry has proposed mandatory labeling for products with a turnover “without ensuring its traceability can entail damage to life and health of citizens, protection of nature and cultural values, the security of the state…”
— On the basis of these criteria, it is impossible to clearly determine whether the product is mandatory labeling KEYS, — stated in the opinion of the Ministry of economic development.
The document stresses that “the text of the draft is not obvious how and on what grounds needs to be established and operate a system of voluntary labelling”. In the project of the Ministry of Finance said that such a system can be created legal and natural person registered as individual entrepreneur.
— With this assumption it becomes possible to simultaneously create different legal entities, producers of identical goods, its system of voluntary labelling for the same product, — said the Ministry of economy.
Thus, one legal entity will be forced to follow the rules of the registered mark of another legal entity.
Also the MAYOR has noticed that the Ministry of Finance proposed to extend the law to the entire territory of the Eurasian economic Union (EEU), using the wording of the law “does not apply to the transportation of goods placed under the customs procedure when they are exported outside the customs territory of the Eurasian economic Union.”
From this it follows that all the goods in the territory of the EAEU should be marked KEYS. However, it should be noted that the Russian Federation is not entitled to unilaterally set mandatory labelling requirements for all the countries of the Eurasian economic Union, — said in the opinion of the Ministry of economic development.
The Finance Ministry acknowledged that comments on the draft also expressed in the Ministry of industry and trade, the Ministry of health, Federal tax service, Rospotrebnadzor and the Russian alcohol regulation Department. These agencies did not answer the query of “Izvestia”.
The Finance Ministry said that the results of the received comments and proposals from the departments is the completion of the project, after which it will be resubmitted for approval.

Director for public relations RATEK Anton Guskov sure that for household appliances the labelling system of products redundant. In his opinion, technology should not fall under mandatory labeling, as it is not a commodity the turnover of which without a traceability system may cause damage to people’s lives, and the voluntary labelling is not necessary because the equipment is easily identifiable, for example by serial numbers.
In the framework of the EAEU is already developing a pilot project on mandatory labeling of fur products, which has proved popular — 20% of market participants not previously reporting to the tax authorities, to legalize their business. The Eurasian economic Commission (EEC) decided to expand the list of goods that will be equipped with labels.
— Currently the Commission is collecting proposals from the member countries of the Union on items for future marking, — reported the press service of the EEC.
