Senate Democrats point out that the Pentagon has no right to use the allocated funds for other purposes
Senate Democrats Jack reed and dick Durbin wrote a letter to Secretary of defense James Mattis after the appeared messages that the President trump has ordered the Pentagon to explore the possibility of transferring part of its budget for the construction of the wall between USA and Mexico.
Senators pay attention to the fact that the financing of the construction of the wall can only occur by cutting other programs of the Ministry of defense. Lawmakers asked the Pentagon to provide the legal grounds for the use of funds for construction.
“As you know, the appropriations made by Congress, limited to the purpose for which they were designed, in accordance with the law… the Law on appropriations of the Ministry of defence for the year 2018 provides for the payment, maintenance and equipment of the Armed forces, but does not contain the appropriation for the construction of a wall along the US border”, – stated in the letter.
“Based on a thorough review of the laws of the appropriation of the text of the appropriation Act of the Ministry of defence in 2018… we came to the conclusion that the Ministry of defence has no legal grounds to use the allocated funds for the construction of a wall on the border,” say the authors of the letter.
