The Supreme court upheld the verdict of the Ukrainian nationalists, Mykola Karpiuk and Stanislavka Klychu. The court overturned a private definition in respect of the counsel for the accused. Previously, the Supreme court of Chechnya has asked to deprive of the status of two of the defenders.

The court session on Wednesday was a great stir — the process suddenly came the Deputy of the Verkhovna Rada Hope Savchenko. After her courtroom was filled with several dozen journalists.

The court Savchenko arrived in embroidery, a break in the meeting shouted to the condemned with the words “Glory to Ukraine” and continued the conversation in Ukrainian.

Prisoners who participated in the process via video conferencing, installed at the detention facility in the Chechen Republic, where they are answered also in Ukrainian. In Russian, they spoke only the phrase, “the will of God.”

Before making a decision Savchenko ignored all the questions of the journalists who tried to find out how long she plans to stay in Moscow and that’s going to do.

Lawyer Ilya Novikov, commenting on the arrival of Savchenko, said that she came to show the convict and all around that you can get 20 years and then wiitm free. She Savenko left the courthouse, and not lightened for questions from Russian journalists.

In March, the Donetsk city court found Savchenko is guilty of murder of journalists of the TV company VGTRK in the Donbass, and was sentenced to 22 years in prison. But two months later she was pardoned by the President and transmitted to the Ukrainian side.

The convoy

The verdict of the former members of the Ukrainian nationalist organization “Ukrainian national Assembly — Ukrainian national self defense” (UNA-UNSO organization banned in Russia) Nikolay Karpyuk and Stanislavka Klychu the Supreme court of the Chechen Republic issued in may on the basis of accusatory verdict of the jury. The court found them guilty in the murder of Russian soldiers during first Chechen campaign, and banditry (article 105 and 209 of the Criminal code) and sentenced Karpyuk to 22,5 years of imprisonment, and Cliche to 20. Part of the period, according to the court, both prisoners must spend in prison, some in the colony.

According to investigators, the defendants were part of the squad “Viking”, and in a few days — from 31 December 1994 to 5 January 1995 in Grozny took part in the murder of Ukrainians 30 Russian soldiers and the assassination of another person. In particular, the prosecution insisted that they fired a column of armored vehicles that entered the city.

The main evidence in the case were a confession of their alleged accomplice Alexander Malofeyev, who concluded pre-trial cooperation agreement. Malofeev testified against the leader of the banned in Russia “Right sector” Dmitry Yarosh, the leader of the party “Freedom” Oleg Tyagnybok and the former Prime Minister of Ukraine Arseniy Yatsenyuk.

Disagreeing with the decision, the convicts, their lawyers appealed to the Supreme court.

Speaking at the Supreme court on Wednesday, lawyers asked to cancel a sentence of the armed forces of the Chechen Republic and to justify Karpyuk and Cliche. Defenders insisted that their principals never participated in the first Chechen campaign and was not in the country. Never been in Chechnya and witness Malofeev, insisted the lawyers. Alibi also convicted can confirm dozens of witnesses, told the court the defenders.

“In December 1994 — January 1995, My client Klyh was in Kiev and passed exams at the Institute, it can confirm how his fellow students and teachers”, said one of the lawyers. She insisted that Klyh was a diligent student and would not go anywhere during the winter session.

In turn, the lawyer Ilya Novikov asked the court to apply the Statute of limitations, and to stop prosecution of both accused. He reminded that by law the question of the dismissal of felony counts by reason of expiration of time taken by the court in each case individually.

“The whole world knows who took part in the fighting, and who did not take, — said the last word Karpyuk. — this whole process is needed in order to get revenge on me for what I am Ukrainian, and show the rest that there is nothing to speak.”

Thus the Prosecutor insisted on the legality of the sentence and asked to leave it in force.
